Registration of Trademark in Taiwan

An enterprise in China’s inland, who hopes its trademarks can be used and protected by law in Taiwan area, shall apply for registration of its trademarks to Taiwan Intellectual Property Office.

ocuments required in application for trademark registration in Taiwan:

1. Application: It is a must to fill in the Application for Registration of Trademark printed by the competent trademark authority. The application shall indicate the name of trademark for registration, the category and name of commodity for its use, applicant’s name, address, service office or firm.

2. Sample of trademark: the sample shall be made of the tough and clean paper with the length and width of less than five (5) cm. 15 samples are required. If it is in color, please attach three (3) black-and-white drafts together.

3. Documents for applicant: The copies for Certificate for Registration of Factory, Certificate for Registration of Profit-making Enterprise or business license.

4. Other documents: such as letter of authorization for agent, copy of trademark registration certificate and so on.

The period of validity of the trademark registered in Hong Kong shall be ten (10) years. The trademark registrant can apply for the registration renewal within six (6) months prior to the date of expiration. Where the registrant doesn’t use the registered trademark successively for three (3) years, others can apply for registration cancellation of its trademark in Taiwan.
