Registration of Trademark in Hong Kong

Intellectual Property Department (IPD) of Hong Kong Special Administrative Region (HKSAR), handles trademark applications and registrations in Hong Kong.

I. Pre-application inquiry: The applicant for registration of trademark can apply for trademark search and initial opinion to IPD so that it can search trademarks in Hong Kong via computer to check whether the identical or similar trademarks have been registered in the identical or similar categories of commodities.

II. Application for registration of trademark:

1. Application conditions

A. The applicant can be a natural or legal person;

B. Provide the name of trademark in Chinese or foreign languages (whether the device is required can be inquired);

C. Provide the names of commodities or list of items for protection;

D. If your trademark is in color, it is necessary to indicate which color shall be used for application for trademark registration.

2.Material required in application for trademark registration:

A. In case of the application in the name of legal person, provide copies of business license and registration certificate; in case of the application in the name of a natural person, copies of individual identity must be provided;

B. Provide the clear sample of trademark;

C.Fill in the application form that must be signed by the applicant or its authorized representative.

The period of validity of the trademark registered in Hong Kong shall be ten (10) years and the registration can be renewed. The period of validity of each renewal of registration shall be ten years and cannot be renewed indefinitely. The application for renewal of registration shall be filed within six months from the date of expiration and the related charges for renewal shall be paid.
